GOGOMAKER Terms of Service

1. Eligibility

• You must be at least 13 years old (or the minimum age required under Malaysian law).
• If you are under 18, you must obtain parental or legal guardian consent.
• If using the Service on behalf of an entity, you represent that you have authority to bind that entity.

2. Account Registration

You agree to:

• Provide accurate and complete information
• Maintain updated account details
• Keep your login credentials secure

You are fully responsible for all activity under your account.

We reserve the right to:

• Suspend duplicate accounts
• Terminate accounts violating these Terms
• Merge or delete suspicious accounts

Account sharing or resale is strictly prohibited.

3. Service Description

GOGOMAKER provides AI-powered tools including:

• Image to Video
• Text to Video
• Text to Image
• Image to Image
• Related AI creative features

We may modify, suspend, or discontinue any part of the Service at any time without liability.

4. Acceptable Use

You must not:

• Use bots, crawlers, or automated scraping
• Bypass credit limits
• Interfere with platform security
• Upload illegal or infringing content

Violation may result in immediate termination without refund.

5. Intellectual Property

5.1 Platform Ownership

All platform software, branding, design, and system infrastructure belong to PJ Perfect Twelve Enterprise. You receive a limited, revocable, non-transferable license to use the Service.

5.2 User Content

You retain ownership of uploaded content. You warrant that you have legal rights to upload all materials.

5.3 Generated Content

As between you and us, generated content belongs to you. However:

• AI copyright laws are evolving
• We do not guarantee copyright eligibility
• We do not guarantee non-infringement

You are solely responsible for how you use generated content.

5.4 License to Operate

You grant us a limited license to process your content strictly to:

• Operate the Service
• Maintain system security
• Improve performance

We will not publicly display your content without separate consent.

6. AI Disclaimer

You acknowledge:

Content Quality Disclaimer

All images and videos generated by the platform are created using artificial intelligence technology. While we strive to deliver high-quality outputs, we do not guarantee that all generated content will be free from errors, inaccuracies, distortions, glitches, or other unintended imperfections.

Performance & Traffic Disclaimer

We do not guarantee any specific results, including but not limited to views, engagement, traffic, conversions, or commercial performance, from the use of generated images or videos. Content performance may vary depending on multiple external factors beyond our control.

• AI output may resemble existing works
• AI systems are probabilistic
• We do not guarantee originality, legality, or suitability for commercial use

Use of generated content is entirely at your own risk.

7. Subscription & Billing

7.1 Payment Authorization

By subscribing or purchasing credits, you authorize us to charge your selected payment method. You are responsible for maintaining valid payment details. Failed payments may result in immediate suspension of paid features.

7.2 Monthly Subscription (Only Plan Available)

GOGOMAKER offers monthly subscription plans only.

• Subscriptions renew automatically only if payment is successfully processed.
• If payment fails, is declined, or reversed, your subscription will not renew and access to paid features will stop immediately at the end of the current billing cycle.
• You may cancel before renewal via your account settings.
• Cancellation prevents future charges but does not entitle you to refund for the current billing period.
• No partial refunds for unused subscription time.

8. Refund Policy

8.1 One-Time First Trial Refund

We offer a one-time trial refund subject to strict conditions:

• Applies only to first-time paid users
• Must be requested within 7 days from account registration
• Refund applies only to unused credits
• Used credits are non-refundable
• After 7 days, no refund will be granted

Refund requests are only valid if submitted within the first 7 days from the date of account activation. Requests made after this period will not be eligible for any refund.

Once the refund request has been reviewed and approved, and the necessary bank details have been confirmed with the user, the refund amount will be transferred to the user's designated bank account within fourteen (14) working days.

Refunds are strictly calculated on a proportional basis according to unused credits. All used credits are non-refundable.

8.2 No Refund After 7 Days

After 7 days from account registration:

• No refunds will be granted
• Unused credits are non-refundable
• Subscription fees are non-refundable

By purchasing digital credits, you acknowledge that service delivery begins immediately.

8.3 No Refund for AI Dissatisfaction

Subjective dissatisfaction with AI output (including style, creativity, or expectations) does not qualify for refund.

8.4 Limited Technical Exception

Refunds may only be considered for:

• Verified duplicate billing
• Confirmed system billing error
• Platform outage exceeding 96 consecutive hours directly affecting paid access

Temporary slowdowns or maintenance do not qualify.

8.5 Chargebacks & Payment Disputes

If you initiate a chargeback without first contacting us:

• Your account may be suspended immediately
• We will submit system logs and these Terms as evidence
• Malicious disputes may result in permanent termination

We reserve the right to pursue legal remedies under Malaysian law.

9. Fraud & Abuse

We may suspend or permanently terminate accounts for:

• Stolen payment usage
• Multiple account abuse
• Credit manipulation
• Refund exploitation
• Reselling account access

We reserve the right to recover financial losses and report serious fraud.

10. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE".

To the maximum extent permitted under Malaysian law, we disclaim:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Error-free operation

Use of the Service is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by Malaysian law:

• We are not liable for indirect or consequential damages
• We are not liable for copyright disputes arising from user-generated content
• Our total liability shall not exceed the total amount you paid in the preceding 12 months

This applies regardless of legal theory.

12. Indemnification

You agree to indemnify and hold harmless PJ Perfect Twelve Enterprise from any claims arising from:

• Your use of the Service
• Violation of these Terms
• Infringement of third-party rights

13. Termination

We may suspend or terminate accounts at our discretion for policy violations.

Upon termination:

• All access ends immediately
• No refunds will be issued unless required by law

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Malaysia.

Any dispute shall be subject to the exclusive jurisdiction of the courts of Malaysia.

Before initiating legal action, you agree to contact hello@gogomaker.com.my to attempt good-faith resolution.

15. Changes to Terms

We may update these Terms at any time.

Updated Terms take effect upon posting.

Continued use of the Service constitutes acceptance.
